Maladministration in Frontex
The Operations Director of FRONTEX, German border policeman Klaus Rosler, is earmarked and set to become the EU border-control coordination agency’s next Director General. This despite his coming under the scrutiny and fire of the EU Ombudsman when it was established that there was maladministration on the part of Frontex arising from its failure to abide by fair procedure and the principles of good administration in relation to a Swedish complainant’s attempts to defend himself against allegations raised by Frontex.

The substance of the complaint was that Frontex’s Rosler, in his capacity as Director of Operations, had falsely accused the complainant (a career Swedish interpreter of Lebanese descent) of having committed irregularities during his deployment; that Frontex never investigated the accusations and never gave him the opportunity to defend himself and to clear his name. Added to all this, following these unsubstantiated accusations, Frontex dismissed the Swedish complainant without giving a proper reason. It did so in spite of having committed itself to using the complainant’s services for 259 days during the year 2012 and in breach of the NoU signed with Sweden as a EU Member State, on 13 December 2011.
The Ombudsman closes it with the following critical remarks:
”There was maladministration on the part of Frontex arising from its failure to abide by fair procedure and the principles of good administration in relation to the complainant’s attempts to defend himself against allegations raised by Frontex.”
Many observers ask if he could he become the next Frontex Executive Director with this clearly proven track record of maladministartion?
